1. Nature of Products
ROFNY specializes in authenticated pre-owned (Pre-Owned / Pre-Loved) luxury goods. Unless explicitly marked as “Brand New” or “Unworn” on the product page, all products sold on this platform are second-hand items that have been previously owned and used.
Due to the nature of second-hand goods, signs of prior use may be present (such as hardware wear, leather creases, scratches, or residual odors). By placing an order, the buyer acknowledges and accepts that the item is not brand new and that ROFNY makes no further warranties in this regard.
2. Authenticity Guarantee
ROFNY guarantees that all items sold on the platform undergo a strict authentication process to ensure authenticity. The authentication is performed either by ROFNY’s in-house specialists or by approved third-party authenticators in accordance with widely accepted industry standards.
However, due to the nature and source of the items, ROFNY does not guarantee that every product includes original packaging, dust bags, authenticity cards, purchase receipts, or other branded accessories. If such accessories are included, they will be clearly indicated on the product page; otherwise, they are deemed not included.
3. Product Descriptions and Variations
ROFNY is committed to providing accurate product information and images. For items with multiple quantities of the same model, only one representative unit will be photographed, while the condition of other units will be detailed in the product description section.
Color, size, and condition may vary slightly due to lighting conditions, screen settings, and subjective assessments. ROFNY shall not be held liable for misunderstandings or inconveniences caused by such permissible variations.
4. Third-Party Brands and Product Disclaimer
All brand names, trademarks, and logos displayed on this platform are the property of their respective owners. ROFNY is not an authorized reseller of these brands unless explicitly stated. Any reference to brand names is for identification purposes only.
5. Order Acceptance and Cancellation Rights
All orders placed through this platform are subject to final review and confirmation by ROFNY. We reserve the right to cancel any order at our sole discretion, including but not limited to the following circumstances:
For orders shipped outside the United States, ROFNY may apply enhanced verification procedures and reserves the right to decline fulfillment due to risk-related concerns. If an order is canceled, any received payments will be refunded. No additional compensation will be provided.
6. Pricing and Taxes
All product prices listed on this platform are denominated in U.S. Dollars (USD). ROFNY reserves the right to adjust prices at any time without prior notice.
Depending on the buyer’s location and applicable laws, additional charges such as sales tax, customs duties, import taxes, shipping fees, and administrative processing fees may apply and are the sole responsibility of the purchaser. ROFNY shall not be liable for any delays, surcharges, or costs resulting from destination tax changes, customs clearance, or other regulatory actions.
In the case of international returns, any such taxes, duties, or fees already collected will not be refunded. Buyers seeking a refund of these amounts must contact the relevant tax or customs authority directly. ROFNY is not responsible for processing such refunds.
7. Shipping and Delivery
ROFNY offers domestic shipping within the United States as well as international delivery. Risk of loss and title for the items pass to the buyer upon transfer to the shipping carrier.
All delivery times are estimates and may vary depending on destination, customs clearance, flight schedules, and unforeseen events. ROFNY shall not be liable for any delays or losses arising from such causes.
8. Return and Refund Policy
Due to the second-hand nature of the items sold, all sales are final. Once sold, products are not eligible for return or exchange.
ROFNY does not accept return requests based on personal preferences or subjective reasons, including but not limited to:
If you believe the received item materially deviates from its product description or is not authentic, you must file a claim with ROFNY within 5 business days of receipt and provide sufficient supporting documentation (e.g., third-party or brand authentication reports).
ROFNY reserves sole discretion to determine the validity of any claim and whether to issue a refund or compensation. Claims filed after the deadline or lacking supporting evidence will not be accepted.
9. Participation in the TRYGVE Leasing Program
Customers may choose to enroll eligible items purchased from ROFNY into the TRYGVE Leasing Program. The specific terms, leasing rates, risk responsibility, and other rights and obligations are governed by a separate agreement between the participant and TRYGVE.
ROFNY merely facilitates introductions and technical integration. It is not the operator or contractual counterparty of the leasing program and assumes no liability for its performance, revenue, or disputes.
10. Data Sharing and User Consent
By choosing to participate in the TRYGVE Leasing Program, you expressly consent to ROFNY sharing your personal information (including but not limited to contact details, order information, and transaction records) with TRYGVE for the purpose of processing leasing applications, managing assets, and delivering related services.
TRYGVE will handle your data in accordance with applicable data protection laws (including but not limited to the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA)) and shall not use the data for unauthorized purposes.
ROFNY is a data provider only and shall not be held liable for how TRYGVE handles your personal data. Users may contact TRYGVE directly to access, update, or request deletion of their information.
11. User Conduct and License Restrictions
ROFNY grants you a non-exclusive, non-transferable, and revocable limited license to access and use this website in accordance with these Terms. You agree not to engage in any of the following:
ROFNY reserves the right to take corrective actions based on the severity of the violation, including but not limited to issuing warnings, suspending accounts, permanent bans, and pursuing legal remedies.
12. Limitation of Liability
To the fullest extent permitted by law, ROFNY shall not be liable for any direct, indirect, incidental, special, or consequential damages (including but not limited to loss of profits, goodwill, data, or business interruption) arising from your use of or inability to use this platform, data loss, delayed delivery, content errors, or system interruptions—even if ROFNY has been advised of the possibility of such damages.
All products and services are provided on an "as-is" and "as-available" basis. ROFNY disclaims all express or implied warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
13. Indemnification
You agree to indemnify, defend, and hold harmless ROFNY, its affiliates, directors, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including but not limited to legal fees and administrative costs) arising from your violation of these Terms, your use of the platform, submission of false information, breach of any applicable laws, or infringement upon the rights of ROFNY or any third party.
ROFNY reserves the right to seek equitable relief and take necessary measures to prevent further loss or damage.
14. Amendments
ROFNY reserves the right to amend, update, or supplement these Terms at any time at its sole discretion without prior notice to users. Once published on this website, the updated Terms become immediately effective and legally binding.
It is your responsibility to review the Terms regularly. Continued use of the platform following any updates constitutes your acceptance of the revised Terms. If you do not agree with the amendments, you should immediately discontinue use of the website and its services.
15. Governing Law and Jurisdiction
These Terms (including any provisions related to TRYGVE leasing or asset management collaboration) shall be governed by the laws of the State of Wyoming and the State of Delaware, excluding their conflict of law rules.
All disputes arising from or in connection with these Terms shall be exclusively submitted to the competent courts of Wyoming or Delaware, and both parties hereby waive any objection to such jurisdiction.
These Terms expressly exclude the application of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
